{"id":182013,"date":"2023-08-17T13:44:03","date_gmt":"2023-08-17T23:44:03","guid":{"rendered":"https:\/\/www.hawaii.edu\/news\/?p=182013"},"modified":"2023-08-17T15:42:40","modified_gmt":"2023-08-18T01:42:40","slug":"clarifying-maunakea-management-transfer","status":"publish","type":"post","link":"https:\/\/www.hawaii.edu\/news\/2023\/08\/17\/clarifying-maunakea-management-transfer\/","title":{"rendered":"Regents approve resolution clarifying Maunakea management transfer"},"content":{"rendered":"<span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Reading time: <\/span> <span class=\"rt-time\"> 2<\/span> <span class=\"rt-label rt-postfix\">minutes<\/span><\/span><p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.hawaii.edu\/news\/wp-content\/uploads\/2022\/02\/system-maunakea-grnc.jpg\" alt=\"snow on Maunakea\" width=\"676\" height=\"381\" class=\"aligncenter size-full wp-image-155699\" srcset=\"https:\/\/www.hawaii.edu\/news\/wp-content\/uploads\/2022\/02\/system-maunakea-grnc.jpg 676w, https:\/\/www.hawaii.edu\/news\/wp-content\/uploads\/2022\/02\/system-maunakea-grnc-300x169.jpg 300w, https:\/\/www.hawaii.edu\/news\/wp-content\/uploads\/2022\/02\/system-maunakea-grnc-130x73.jpg 130w\" sizes=\"auto, (max-width: 676px) 100vw, 676px\" \/><\/p>\n<p>The University of <span aria-label=\"Hawaii\">Â鶹´«Ã½<\/span> <a href=\"https:\/\/www.hawaii.edu\/offices\/bor\/\">Board of Regents<\/a> (<abbr>BOR<\/abbr>) approved a resolution at its Thursday, August 17, meeting to clarify the university\u2019s role regarding the transfer of <abbr>UH<\/abbr>\u2019s management responsibilities on Maunakea to the Mauna Kea Stewardship and Oversight Authority (<abbr>MKSOA<\/abbr>).<\/p>\n<p>The <abbr>MKSOA<\/abbr> was established by the <span aria-label=\"Hawaii\">Â鶹´«Ã½<\/span> State Legislature in 2022 with the passage of Act 255. Among other things, Act 255 sets a five-year transition period, starting July 1, 2023 and ending on July 1, 2028.  At that time, Act 255 expects that all general leases, easement, and permits issued by the Board of Land and Natural Resources (<abbr>BLNR<\/abbr>) to <abbr>UH<\/abbr> are transferred and assigned to <abbr>MKSOA<\/abbr>. The transfer may occur sooner than July 1, 2028, if <abbr>BLNR<\/abbr> and <abbr>MKSOA<\/abbr> allow.<\/p>\n<p>The proposed resolution lists seven actions to be completed by <abbr>UH<\/abbr> during the transition period, while <abbr>UH<\/abbr> still holds general leases, easement, and permits issued by the <abbr>BLNR<\/abbr> to <abbr>UH<\/abbr>:<\/p>\n<ul>\n<li>Progress reports to the <abbr>BOR<\/abbr> every six months.<\/li>\n<li>Completion of the decommissioning of two Maunakea telescopes (Caltech Submillimeter Observatory and <abbr>UH<\/abbr> Hilo H\u014dku Ke\u02bba Observatory) no later than August 31, 2024, barring unforeseen setbacks.<\/li>\n<li>Establish and fund a new <abbr>UH<\/abbr> Hilo teaching telescope on already developed land at Hale P\u014dhaku, in coordination with <abbr>MKSOA<\/abbr> and <span aria-label=\"Hawaii\">Â鶹´«Ã½<\/span> Department of Land and Natural Resources (<abbr>DLNR<\/abbr>).<\/li>\n<li>The continued development and implementation of educational programs regarding Maunkaea by the <abbr>UH<\/abbr> Hilo \u02bbImiloa Astronomy Center.<\/li>\n<li>Determining by December 30, 2025&#8212;in coordination with <abbr>MKSOA<\/abbr>, the Maunakea Observatories and <abbr>DLNR<\/abbr>&#8212;if three additional Maunakea observatory sites will be decommissioned. If the decision is to proceed with decommissioning, the three sites must be identified and reported to the <abbr>BOR<\/abbr> by January 2026.<\/li>\n<li>The university will continue to make final decisions regarding stewardship obligations, with <abbr>MKSOA<\/abbr>\u2019s input, until the general leases, easement, and permits issued by <abbr>BLNR<\/abbr> to <abbr>UH<\/abbr> related to astronomy facilities are officially transferred and assigned to <abbr>MKSOA<\/abbr>.<\/li>\n<li>Enter into an agreement with <abbr>MKSOA<\/abbr> that outlines how <abbr>UH<\/abbr> and the <abbr>MKSOA<\/abbr> will jointly manage, as that term is used but not defined in Act 255, during the transition period.<\/li>\n<\/ul>\n<p>The proposed resolution also restates <abbr>BOR<\/abbr>\u2019s commitment to its stewardship responsibilities and to honoring the terms and conditions imposed on <abbr>UH<\/abbr> under the general leases, easement, and permits issued by <abbr>BLNR<\/abbr> to <abbr>UH<\/abbr>.
