This revokes Executive Order 13769, and will take effect on March 16, 2017.<\/p>\n<p>On January 27, 2017, President Trump signed <a href=\"https:\/\/www.federalregister.gov\/d\/2017-02281\">Executive Order 13769<\/a>, entitled <em>Protecting the Nation from Terrorist Entry into the United States by Foreign Nationals<\/em>. Among the actions, under Section 3(c) of that Executive Order, entry into the United States of \"immigrants and nonimmigrants\" from at least 7 countries has been suspended for 90 days from the date the Executive Order was signed.<span style=\"color: #ff0000;\"><br \/>\n<\/span><\/p>\n<h2>Legal Advice<\/h2>\n<p>ISS advisors are always available to help navigate this information and support our international students. For a complete review, you can to the <a href=\"http:\/\/www.nafsa.org\/Professional_Resources\/Browse_by_Interest\/International_Students_and_Scholars\/Executive_Order_Entry_Ban_Litigation_Updates\/\">NAFSA website<\/a>.<\/span><\/p>\n<table border=\"1\" width=\"100%\" cellspacing=\"1\" cellpadding=\"1\">\n<tbody>\n<tr>\n<td bgcolor=\"#ffffcc\"><strong>06\/26\/2018<\/strong> - In a 5-4 vote, the U.S. Supreme Court upheld <a href=\"http:\/\/www.whitehouse.gov\/the-press-office\/2017\/09\/24\/enhancing-vetting-capabilities-and-processes-detecting-attempted-entry\">Proclamation 9645<\/a> as related to EO 13780, allowing what has been known as \"Travel Ban 3.0\" to remain in effect. <a href=\"https:\/\/www.supremecourt.gov\/opinions\/17pdf\/17-965_h315.pdf\">Read the Court's full opinion<\/a>.<\/td>\n<\/tr>\n<tr>\n<td><strong>04\/10\/2018<\/strong> - President Trump, through <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/presidential-proclamation-maintaining-enhanced-vetting-capabilities-processes-detecting-attempted-entry-united-states-terrorists-public-safety-threats\/\">Proclamation<\/a>, has removed Chad from the list of countries subject to\u00a0 <a href=\"http:\/\/www.whitehouse.gov\/the-press-office\/2017\/09\/24\/enhancing-vetting-capabilities-and-processes-detecting-attempted-entry\">Proclamation 9645<\/a> pursuant to section 2(e) of EO 13780, effective April 13, 2018.<\/td>\n<\/tr>\n<tr>\n<td bgcolor=\"#ffffcc\"><strong>12\/04\/2017<\/strong> - US Supreme Court rules that President Trump's full <a href=\"http:\/\/www.whitehouse.gov\/the-press-office\/2017\/09\/24\/enhancing-vetting-capabilities-and-processes-detecting-attempted-entry\">Proclamation 9645<\/a> on immigration may be go into effect even as lower courts are still presiding over cases determining its lawfulness.<\/td>\n<\/tr>\n<tr>\n<td><strong>10\/18\/2017<\/strong> - In the US District Court of Maryland, Judge Theodore Chuang grants preliminary injunction against Trump's Proclamation of 9\/24\/2017. However, it does allow for the bans of North Korea and Venezuela to remain.<\/td>\n<\/tr>\n<tr>\n<td bgcolor=\"#ffffcc\"><strong>10\/17\/2017<\/strong> - In the US District Court of Hawaii, Judge Derrick Watson grants a temporary restraining order (TRO) on Trump's Proclamation of 9\/24\/2017.<\/td>\n<\/tr>\n<tr>\n<td><strong>9\/24\/2017<\/strong> - President Trump announces <a href=\"https:\/\/www.whitehouse.gov\/the-press-office\/2017\/09\/24\/enhancing-vetting-capabilities-and-processes-detecting-attempted-entry\">Proclamation on Enhancing Vetting Capabilities and Processes for Detecting Attempted Entry Into the United States by Terrorists or Other Public-Safety Threats<\/a>. These are added restrictions to EO 13780. The following is a summary of the proclamation's suspensions of U.S. entry by nationals of select countries coming as immigrants or nonimmigrants. This does not include other restrictions established previously.<\/p>\n<ul>\n<li>Chad - all immigrants; nonimmigrants as B1, B2, B1\/B2 visaholders<\/li>\n<li>Iran - all immigrants; all nonimmigrants <strong>except<\/strong> for F, M and J visaholders<\/li>\n<li>Libya - all immigrants; all nonimmigrants as B1, B2, B1\/B2 visaholders<\/li>\n<li>North Korea - all immigrants; all nonimmigrants<\/li>\n<li>Somalia - all immigrants; nonimmigrants subject to enhanced screening and vetting<\/li>\n<li>Syria - all immigrants; all nonimmigrants<\/li>\n<li>Venezuela - certain government officials and their immediate family members as B1, B2, B1\/B2 visaholders<\/li>\n<li>Yemen - all immigrants; all nonimmigrants as B1, B2, B1\/B2 visaholders<\/li>\n<li>Iraq - no suspensions, but Secretary of Homeland Security recommends that nationals seeking entry be \"subject to additional scrutiny to determine if they pose risks to the national security or public safety of the United States.\"<\/li>\n<\/ul>\n<p><strong>Effective Date: <\/strong>(from FAQ) The restrictions and limitations took effect at 3:30 p.m. eastern daylight time on September 24, 2017, for foreign nationals who were subject to the suspension of entry under section 2 of E.O. 13780, and who lack a credible claim of a bonda fide relationship with a person or entity of the United States. Also in relation to the recent Supreme Court ruling on June 26, it has updated its <a href=\"https:\/\/www.dhs.gov\/news\/2017\/06\/29\/frequently-asked-questions-protecting-nation-foreign-terrorist-entry-united-states#\">FAQ on EO 13780<\/a>.<\/td>\n<\/tr>\n<tr>\n<td bgcolor=\"#ffffcc\"><strong>June 26<\/strong> - The U.S. Supreme Court partially granted the government's request to stay the preliminary injunctions issued by lower courts. DHS personnel will resume inspection of travelers in accordance with standard policy and procedure.<\/p>\n<p><a href=\"https:\/\/www.cbp.gov\/border-security\/protecting-nation-foreign-terrorist-entry-united-states\">CBP FAQ Page<\/a><\/td>\n<\/tr>\n<tr>\n<td bgcolor=\"#ffffcc\"><strong>February 3<\/strong> \u2013 To comply with the TRO, the U.S. Department of State (DOS) has temporarily lifted its suspension of visa processing, and reversed its directive that revoked the visas of individuals subject to the Section 3(c) entry ban.<\/p>\n<p><a href=\"https:\/\/travel.state.gov\/content\/visas\/en\/news\/executive-order-on-protecting-the-nation-from-terrorist-attacks-by-foreign-nationals.html\">DOS Statement<\/a><\/td>\n<\/tr>\n<tr>\n<td><strong>February 3<\/strong> \u2013 The U.S. District Court for the Western District of Washington in Seattle grants a Temporary Restraining Order (TRO) that temporarily prohibits the Federal government from enforcing Section 3(c) of Executive Order 13769, the provision that established the 90-day ban on entry of \u201cimmigrants and nonimmigrants\u201d from Iran, Iraq, Libya, Somalia, Sudan, Syria, and Yemen. The TRO also prohibits enforcement of Sections 5(a), 5(b), 5(c), and 5(e) of the Executive Order, which established the 120-day suspension of admission of refugees to the United States.<\/p>\n<p><a href=\"https:\/\/www.pacermonitor.com\/view\/OER7PLI\/State_of_Washington_v_Trump_et_al__wawdce-17-00141__0052.0.pdf\">Full Text of Court Order, Feb. 3<\/a><\/td>\n<\/tr>\n<tr>\n<td bgcolor=\"#ffffcc\"><strong>February 3<\/strong> -\u00a0 Department of Homeland Security (DHS) released a statement to clarify the classes of aliens affected by the 90-day temporary pause on travel.<\/p>\n<p><a href=\"https:\/\/www.dhs.gov\/news\/2017\/02\/03\/statement-countries-currently-suspended-travel-united-states\">DHS Statement, Feb. 3<\/a><\/td>\n<\/tr>\n<tr>\n<td><strong>February 3<\/strong> \u2013 U.S. Citizenship and Immigration Service (USCIS) released a statement that says it \u201ccontinues to adjudicate applications and petitions filed for or on behalf of individuals in the United States regardless of their country of origin, and applications and petitions of lawful permanent residents outside the U.S. USCIS also continues to adjudicate applications and petitions for individuals outside the U.S. whose approval does not directly confer travel authorization.
