Reinstatement requires submission of an application and fee to U.S. Citizenship and Immigration Services (USCIS).\u00a0 <strong>Students who have engaged in unauthorized employment are not eligible for reinstatement.<\/strong>\u00a0 Instead of reinstatement, some students may choose to regain F-1 status by travel abroad.<\/p>\n<\/div>\n<\/div><\/div><\/div><\/div><div id=\"pg-3398-1\"  class=\"panel-grid panel-no-style\" ><div id=\"pgc-3398-1-0\"  class=\"panel-grid-cell\" ><div id=\"panel-3398-1-0-0\" class=\"so-panel widget_sow-editor panel-first-child panel-last-child\" data-index=\"1\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-sow-editor so-widget-sow-editor-base\"\n\t\t\t\n\t\t>\n<div class=\"siteorigin-widget-tinymce textwidget\">\n\t<h2>Regaining Status by Reinstatement Application<\/h2>\n<ul>\n<li>Why: Student falls out of status for minor offense<\/li>\n<li>When: Best within 5 months of falling out of status<\/li>\n<li>Within 5 months of losing status \u2013 no new SEVIS fee.<\/li>\n<li>Student\u2019s Reinstatement I-20 has old SEVIS number.<\/li>\n<li>Student does not need to or plan to travel abroad. Student should avoid travel while reinstatement is pending<\/li>\n<li>Application: Form I-539 processing fee: https:\/\/www.uscis.gov\/i-539<\/li>\n<li>Process is slow. Student may study while application pending<\/li>\n<li>Student who is reinstated is immediately eligible for all continuing student F-1 benefits (F-1 \u201cclock\u201d continues)<\/li>\n<\/ul>\n<\/div>\n<\/div><\/div><\/div><div id=\"pgc-3398-1-1\"  class=\"panel-grid-cell\" ><div id=\"panel-3398-1-1-0\" class=\"so-panel widget_sow-editor panel-first-child panel-last-child\" data-index=\"2\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-sow-editor so-widget-sow-editor-base\"\n\t\t\t\n\t\t>\n<div class=\"siteorigin-widget-tinymce textwidget\">\n\t<h2>Regaining Status by Travel<\/h2>\n<ul>\n<li>Why: Student falls out of status for an offense<\/li>\n<li>When: See advisor to discuss timing issues<\/li>\n<li>More than 5 months after lost status \u2013 pay SEVIS fee. Student is issued new I-20 with NEW SEVIS number.<\/li>\n<li>Student plans to travel abroad or must travel abroad due to length of time out of status, or due to unauthorized employment<\/li>\n<li>Student does not file I-539 but may need to submit application for new F-1 visa. Additional cost=travel $<\/li>\n<li>Process is generally fast. Generally student travels to his\/her own country and visits US Consul.<\/li>\n<li>Student who regains status by travel must be F-1 for 2 full semesters before regaining eligibility to work off campus in CPT or OPT (F-1 clock restarts).<\/li>\n<\/ul>\n<\/div>\n<\/div><\/div><\/div><\/div><div id=\"pg-3398-2\"  class=\"panel-grid panel-no-style\" ><div id=\"pgc-3398-2-0\"  class=\"panel-grid-cell\" ><div id=\"panel-3398-2-0-0\" class=\"so-panel widget_sow-editor panel-first-child panel-last-child\" data-index=\"3\" ><div\n\t\t\t\n\t\t\tclass=\"so-widget-sow-editor so-widget-sow-editor-base\"\n\t\t\t\n\t\t>\n<div class=\"siteorigin-widget-tinymce textwidget\">\n\t<h2>Reinstatement by submitting an application to USCIS:<\/h2>\n<ol>\n<li>Complete FORM G-1145: <a href=\"https:\/\/www.uscis.gov\/g-1145\">https:\/\/www.uscis.gov\/g-1145<\/a><\/li>\n<li>Complete <strong>FORM I-539 <\/strong>and attach check payable to <strong>Department of Homeland Security: <\/strong><a href=\"https:\/\/www.uscis.gov\/i-539\">https:\/\/www.uscis.gov\/i-539<\/a>.\n<ol>\n<li style=\"list-style-type: upper-alpha;\">In Part 2, question 1, check #3<\/li>\n<\/ol>\n<\/li>\n<li>Copies of all previously-issued I-20s.<\/li>\n<li>Attach verification of finances (support affidavit, bank statement, etc.).<\/li>\n<li>Print out of your I-94: <a href=\"https:\/\/i94.cbp.dhs.gov\/I94\/#\/home\">https:\/\/i94.cbp.dhs.gov\/I94\/#\/home<\/a><\/li>\n<li>Attach copies of your F-1 visa page and your passport biography page<\/li>\n<li>Write a cover letter indicating why you want the USCIS to reinstate you to F-1 status (<a href=\"#sample\">see sample below<\/a>).\u00a0 Be sure to carefully include how and why you violated status and how the violation was beyond your control, as well as your intention to maintain your status in the future.\u00a0 Also address what hardship you would face if your request is denied and you are forced to leave the U.S.<\/li>\n<li>You can make an appointment to have ISS advisor help review your documents.\u00a0 If the advisor is satisfied with your application, a notation of support will be provided.<\/li>\n<li>Obtain new original I-20 form requesting reinstatement from ISS. Allow 3-5 business days.<\/li>\n<li>Sign and date in item # 11 on page 1 of new original I-20.<\/li>\n<li>Make and keep a copy of everything you are sending to USCIS for your personal record.<\/li>\n<li>Mail your application. <a href=\"https:\/\/www.uscis.gov\/i-539\">Refer to I-539 instructions<\/a> for mailing address and processing fee. If mailing by US Postal Service, it is suggested that you use \"Certified Mail, Return Receipt Requested.\"<\/li>\n<li>If submitting more than 5 months since losing status, you must also attach receipt for payment of SEVIS fee.
